By visiting our website, placing an order, uploading content, or otherwise using our services, you agree to these Terms of Service and the policies referenced below. If you do not agree, please do not use the website or purchase our products.
1. Eligibility and Lawful Use
You must be at least the age of majority in your state or jurisdiction, or use this website with the permission of a parent or legal guardian. You may not use our website, products, or services for any unlawful, fraudulent, abusive, or unauthorized purpose, or violate the rights of another person.
2. Custom Products and Uploaded Photos
Our custom keepsakes are created from the photos, names, dates, messages, and customization choices you provide. You confirm that you own the photos and other content you upload, or that you have permission from the applicable rights holder to use them for your order.
You retain ownership of your original uploaded photos. You grant us a limited, non-exclusive permission to process and use your submitted content only as reasonably necessary to design, produce, deliver, and support your order.
We may use AI-assisted tools to remove backgrounds, improve clarity, and refine visual details while working from your uploaded photo. These tools assist our production process; they do not replace your pet with a generic AI-generated image.
We will not use your uploaded order photos or completed custom keepsake for advertising, social media, or other promotional purposes without your separate permission.
3. Photo Quality, Preview, and Approval
You are responsible for providing a clear photo that reasonably shows the pet and details you want included. If a photo is unsuitable, we may contact you to request a replacement. A replacement photo or missing order information may delay the production timeline.
We generally send the first digital preview by email within 24–48 hours after receiving your order and photos. You may approve the preview or request a reasonable adjustment before production begins.
We allow up to 48 hours for your response. If we do not hear back during that period, we may move forward with the preview as shown so your order is not unnecessarily delayed.
Once a preview is approved, or the response period has passed and production has begun, further changes might not be possible and may require additional time or cost.
4. Orders, Prices, and Payment
All orders are subject to acceptance and product availability. Prices, promotions, and product availability may change, but changes will not affect an order already accepted by us unless there is an obvious pricing or listing error.
You agree to provide accurate billing, contact, customization, and delivery information. We may refuse or cancel an order for suspected fraud, unauthorized payment, unlawful content, technical errors, or a violation of these Terms.
If we cancel a paid order before fulfillment, the applicable payment will be refunded to the original payment method.
5. Production, Shipping, and Delivery
Production and delivery dates are estimates and can be affected by preview revisions, replacement photos, order volume, carrier delays, weather, and holidays. Shipping timelines, carriers, tracking, and delayed-package procedures are explained in our Shipping & Delivery.
6. Cancellations, Returns, and Satisfaction Guarantee
Because custom products are made specifically from your submitted photo and selections, cancellation or change-of-mind returns may not be available after design or production work has begun.
Our 30-Day Peace of Mind guarantee and the rules for refinements, replacements, cancellations, damaged products, and refunds are governed by our Return & Exchange Policy.
Nothing in these Terms limits rights that cannot legally be excluded under applicable consumer protection law.
7. Product Appearance
We make reasonable efforts to display product examples and colors accurately. Because each item is custom-made, minor differences in color, cropping, scale, placement, resin finish, and handmade details may occur. Device displays can also reproduce colors differently. These reasonable variations are not considered defects.
8. Intellectual Property and Personal Use
The website, branding, logos, text, graphics, product examples, layouts, and original design materials owned by YP PETS | Custom Keepsakes are protected by applicable intellectual property laws. You may not reproduce, resell, distribute, or commercially exploit this material without written permission.
Purchasing a physical custom product gives you ownership of that physical item for personal use. It does not transfer ownership of our website content, production methods, templates, branding, or other intellectual property. Contact us before using a custom design for resale or another commercial purpose.
9. Reviews, Feedback, and Voluntary Submissions
If you voluntarily post or submit a review, testimonial, public comment, or feedback, you grant us a non-exclusive, royalty-free permission to display, reproduce, and format that submission for operating and promoting our business, subject to applicable law.
This section does not give us permission to use private order photos or custom artwork for marketing. We will request separate permission before using those materials for promotional purposes.
10. Third-Party Services and Links
Our store may use or link to third-party services, including Shopify, payment processors, upload tools, shipping carriers, and tracking providers. We are not responsible for the independent content or practices of third-party websites. Your use of a third-party service may also be governed by that provider’s terms and privacy policy.
11. Privacy and Payment Information
Our handling of personal information and uploaded photos is described in our Privacy Policy. Payments are processed through Shopify and applicable payment providers. We do not independently store complete payment-card details.
12. Errors and Corrections
We may correct typographical errors, inaccurate product information, pricing mistakes, or availability errors. If an error materially affects an order you have already placed, we will contact you and provide an appropriate correction, cancellation option, or refund where applicable.
13. Prohibited Uses
You may not use the website to violate any law; infringe intellectual property, privacy, or publicity rights; submit unauthorized images; transmit malicious code; interfere with site security; collect information about others without permission; or engage in fraudulent, abusive, harassing, or misleading activity. We may refuse service or restrict access for violations of this section.
14. Disclaimer of Warranties
Except for guarantees expressly stated in our Return, Exchange & Refund Policy and rights that cannot be excluded by law, the website and services are provided on an “as available” basis. We do not guarantee uninterrupted or error-free access to the website. This disclaimer does not override any written product guarantee we expressly provide.
15. Limitation of Liability
To the fullest extent permitted by law, Yanpin Yanzi LLC and YP PETS | Custom Keepsakes will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website or products. Our total liability for a claim relating to a purchase will not exceed the amount paid for the product giving rise to the claim. These limitations do not apply where liability cannot legally be limited or excluded.
16. Indemnification
You agree to be responsible for claims, losses, or reasonable costs resulting from your unlawful use of the website, your breach of these Terms, or content you submit without the necessary ownership or permission, to the extent permitted by law.
17. Termination
We may suspend or terminate access to the website when reasonably necessary to address fraud, abuse, security risks, unlawful conduct, or material violations of these Terms. Obligations relating to completed purchases, payment, intellectual property, liability, and dispute resolution survive termination where applicable.
18. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where mandatory consumer laws require otherwise. Subject to applicable law, disputes relating to these Terms will be brought before a court of competent jurisdiction in New York County, New York.
19. Changes to These Terms
We may update these Terms by posting a revised version on this page and changing the “Last updated” date. Changes apply prospectively from the date posted unless applicable law requires otherwise.
20. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. These Terms, together with the policies linked on this page, form the agreement governing your use of the website and purchases from YP PETS | Custom Keepsakes.
